BMC WARRANTY CONDITIONS

1. MANUFACTURER’S WARRANTY

The buyer benefits from guarantees in accordance with the provisions below.

2. PRODUCTS COVERED BY THE WARRANTY

The warranty covers only frames, non-suspended forks and components manufactured by BMC (hereinafter referred to as « BMC products »). The warranty covers only new BMC products purchased from a BMC dealer. All other parts and components are excluded from this warranty.

3. DURATION OF THE WARRANTY

Duration of BMC warranty from the date of delivery:

paint: 2 years (1 year on models before 2014)

other BMC products: 2 years

The purchaser of a bicycle from the 2011 model year onwards can benefit from a 3- to 5-year (three to five years) warranty extension by registering their frame on the BMC website within 30 days (thirty days) from the date of purchase from a BMC dealer. There is no warranty extension in the event of frame repair or exchange.

4. EXCLUSION OF WARRANTY

The following parts/components and circumstances are excluded from the warranty or are grounds for warranty exclusion:

any technical modifications made to the bicycle without the manufacturer’s consent
the subsequent assembly or transformation of or with any non-original or incompatible parts
wear parts such as bearings, ball bearings, bearing axles, etc.
non-BMC parts/components
indirect damage
any interventions that the BMC dealer could have carried out himself
any incorrect use or transport
the absence of scheduled inspections
incorrect maintenance (the user manual must be followed!)
any damage caused by the absence of adequate adjustments or due to faulty adjustments or due to wear of components
the consequences of falls
damage caused by bad weather or abnormal wear
damage caused by the use of inappropriate cleaning products or additives or tools such as high-pressure cleaners
any rental or transfer for commercial purposes

5. SCOPE OF THE WARRANTY

BMC provides the following guarantees for the warranty period:

At BMC’s discretion, repair or replacement with equivalent parts/components, replacement parts may be of a different model or color.
Services not covered by the warranty and falling within the reseller’s responsibility, as well as cleaning of dirty bicycles, are charged at the current hourly rate, including parts and transport.
Warranty services (repair/replacement) do not extend the initial warranty period.
No other warranty is granted in addition to the warranties specified above.

6. EXERCISE OF THE WARRANTY

The warranties must be claimed using the duly completed warranty form, accompanied by a copy of the warranty certificate or the purchase invoice from a BMC dealer, all to be given to your BMC dealer.
Your BMC dealer will send us your request, accompanied by photos of the defective parts, specifying the frame number. BMC will decide by return on the application of the warranty. If a parts inspection is requested, these must be sent to BMC after disassembly and cleaning.
Repaired or replaced products are returned to the BMC dealer. It is the latter who must reassemble the parts and adjust the bike, failing which any warranty may be excluded.

7. REPLACEMENT IN THE EVENT OF AN ACCIDENT

For some models, it is possible to benefit from a one-time replacement in the event of an accident, provided that you have registered on the BMC website (see article 3). The conditions of participation and the list of models concerned can be consulted on the ‘Crash Replacement’ website.

8. SAFEGUARD CLAUSE

The present or future invalidity of one of these provisions or the finding of a gap shall not affect the validity of the other provisions. In place of any ineffective or missing provision, a provision that comes closest to the initial intention shall be agreed.

9. APPLICABLE LAW AND COMPETENT JURISDICTION

It is agreed that for all disputes arising from or relating to this warranty (including its formation or validity) the courts of the Canton of Solothurn shall have exclusive jurisdiction. This purchase contract is subject to Swiss law, excluding the conflict of laws provisions and the United Nations Convention on Contracts for the International Sale of Goods (UN Commercial Law).
